Victimisation

Victimisation is when a person victimises another person because they:

  • have made, or intend to make, a complaint to the Anti-Discrimination Commission
  • have given, or intend to give, evidence or information in connection with a hearing at the Anti-Discrimination Commission
  • have alleged, or intend to allege, that a person has committed an act which would amount to a contravention of the Anti-Discrimination Act
  • have done anything in relation to a person under or by reference to the Anti-Discrimination Act.

Victimisation occurs if a person subjects or threatens to subject another person or an associate of the other person to any detriment.

It does not apply in relation to an allegation that is false and not made in good faith.
